The MyMuse Platform is made available by MyMuse India Private Limited (“our”, “us”, “we”, “Company”), having its registered office at 401/2, Athena Building, Raheja Acropolis, Deonar Village, Mumbai, Maharashtra, India - 400088. In order to provide you with the access to our Platform, Products and Information, we need to collect various data and information from you. This Privacy Policy (“Policy”) details how this data and information is collected, retained, shared, stored, and processed by us. We may revise this Policy as well as update the Platform from time to time. Please visit this page regularly to take notice of any changes we make. Continued use of the Platform after an update constitutes consent to the updated policy. If you do not agree with any part of this Policy, please stop using our Platform immediately. This Policy incorporates and includes our Terms of Use available here. Words and phrases not defined in this Policy shall have the same meaning as provided in the Terms of Use

1. Information We Collect

We collect the data you provide only to ensure that we can provide you access to our Platform and Products in the best manner possible. By using the Platform you consent to providing us data in the ways listed below.

1.1 Data added by you. We collect the information that you actively input into the Platform:

a) MyMuse Account data: We collect the data you provide to us when you create or update your MyMuse Account, or while making purchases from the Platform as a Guest. This includes your name, phone number, email ID, delivery address (which may be your home or office address) date of birth, unique User ID, password (as applicable). We may require you to share further data on a later date to confirm the veracity of your information or pursuant to any additional features added to the Platform. We may also require you to share data pertaining to gender, sexual preference and sexual orientation on the Platform to access certain services, provide you with Information and content, or as part of surveys. However, this shall not be mandatory and failure to provide such personal data shall only affect your ability to access such services, Information or content. Any such information, including queries and information for our “Ask the sexpert” content and service, provided to us voluntarily through our Platform, e-mail and other modes of communication to access such services, Information or content may be shared/posted by us on our Platform and/or social media pages anonymously.

b) Financial data: We collect the data you provide to us when you place an order for Products on our Platform. This includes credit or debit card details, e-wallet details and banking details. c) Feedback and other data: We collect and record: (a) any emails you write to us; (b) the calls you make to our call centers, customer service personnel;

(c) any data you submit to us on social media and other modes of communication/platforms

(d) data you input when you participate in our referral programs or use any discount codes offered by us; and

(e) feedback or comments you provide to us on the Platform, including any crash reports and lag reports generated by you.

1.2 Data collected from use of Platform. We collect the following data generated owing to and pursuant to your use of the Platform:

a) Platform usage data: We collect data on your interaction with our Platform, i.e., Platform access dates and times, features or pages viewed, crashes and other system activity, type of browser used to access the Platform, and third-party sites or services used before or in the course of interacting with our Platform.

b) Device data: We may collect data about the devices used to access our Platform, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, serial numbers, browser type, mobile app, file names and types, and plugins.

c) Purchase data: We collect and retain data regarding the Products you add to your cart, purchases from the Platform, the amount spent on the Platform, and the payment methods used to make purchases on the Platform.

d) Cookies, log files, web beacons and tracking pixels: We also collect information through the use of “cookies”, “log files”, “web beacons” and “tracking pixels”, and similar technologies to understand how you navigate through the App to learn your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the App. Log Files track actions that occur on our Platform, and collect data including your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps. Web beacons, tags and pixels are electronic files used to record information about how you browse the Platform.

1.3 Information received from third parties. We may also be working closely with third parties (including, for example, business partners, technical sub-contractors, analytics providers such as Google Analytics, search information providers) and may receive information about you from such sources. Such data may be shared internally and combined with data collected under Section 1.2 (Data collected from use of Platform) above.

2. Use Of Collected Data

The data we collect from you will be used for the following purposes:

2.1. For enabling the Platform. We use the data collected to personalize, maintain and improve our Platform. This includes using the data to:

a) Create and update your MyMuse Account.

b) Fulfill any orders placed for Products on the Platform (including processing your payment information, arranging shipping and providing you with invoices and order confirmations, and/or delivering the products to you).

c) Provide advice on sexual health and wellness.

d) Screen our orders for potential risk or fraud.

e) Perform internal operations necessary to provide you and improve our Platform, including to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends.

f) For improving the Platform.

2.2. For creating detailed user profiles. We may combine and aggregate data collected from you on our Platform, through e-mail and other mediums in order to create detailed and wholesome user profiles in order to understand you better and attempt to provide you with better Products, Information, content and services. Please note that the use of any information shared by you through one mode of communication/platform will not be limited solely to that mode of communication/platform.

2.3. For research and development. We use the data so collected for research, product development, piloting new Products, and improving the UI/UX experience – all of which will ultimately improve how you experience the Platform.

2.4. For enabling customer support and communication. We use the information to provide customer support and train our customer service executives. We may further add features that allow you to call us (through the Platform or otherwise), similarly, we may also need to contact you through the Platform.

2.5. For marketing and outreach. We use the data we collect to market our Products. This includes sharing your feedback, ratings and screen names for purely promotional and marketing purposes. Such promotion and marketing may be done via hoardings, banners, pamphlets etc.

2.6. For fraud detection and preventing misuse. We use the data we collect to detect fraudulent usage of the Platform and/or misuse of any of the features of the Platform.

2.7. For legal compliance and requirements. We use the data we collect to address claims or disputes relating to use of our Platform, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.

3. Sharing Of Data

We do not share any personal data about you with any third parties unless necessary. We may enter into agreements or arrangements to enable the use of our Platform and to provide Products to you. We have detailed the manner in which we share the collected data below:

3.1. Service Providers: We work with third party service providers to execute various functionalities of the Platform, including but not limited to entities such as Shopify for e-commerce facilitation, and we may share your information with such service providers to help us provide you with our Products, Information and other services on the Platform.

3.2. Change in Control: While negotiating or in relation to a change of corporate control such as a restructuring, merger or sale of our assets, we may have to disclose our databases and information we have stored in the course of our operations.

3.3. Law Enforcement: If any governmental authority or law enforcement officers request or require any information and we think disclosure is required or appropriate in order to comply with laws, regulations, or a legal process, then we may disclose the information we collect.

4. Your Rights

It is important to us that you remain in control of your data. Please write to us at support@mymuse.in if you wish to exercise any of your rights provided below:

4.1. Right to rectification. In the event that any personal data provided by you is inaccurate, incomplete or outdated, then you shall have the right to provide us with the accurate, complete and up to date data and have us rectify such data at our end immediately. We urge you to ensure that you always provide us with accurate and correct information to ensure that your use of our Platform is uninterrupted.

4.2. Right to Erasure. You have the right to demand us to erase your personal data and we will do so without undue delay, provided that the data is no longer required by us and there is no legal requirement to retain the data. Do note that multiple legal basis may exist in parallel and we may still have to retain certain personal data at any time, despite your request to delete it.

4.3. Right to Confirmation and Access. You can seek a confirmation from us as to whether any of your personal data is being or has been processed. If we are processing such data, then you may ask us for summary of such processed data. You also have the right to ask us for a brief summary of our processing activities.

4.4. Right to withdraw consent. You may write to us at support@mymuse.in to withdraw your consent to any specific data processing. However, please note that, you may not be able to access certain parts of the Platform, as well as certain services from on the Platform if you withdraw your consent. Do note that despite your withdrawal request, we may continue to retain and store your data as provided in Section 6 (Data Retention) below.

4.5. Right to opt-out. You may opt out of receiving promotional and marketing emails from us by writing to us. You may also opt out of receiving emails and other messages from us by following the unsubscribe instructions in those messages. Please note that opting out of receiving push notifications may impact your use of the Platform. However, even if you opt out of receiving our promotional and marketing e-mails, we will still send you transactional messages through e-mails about your purchases.

5. Consent

By accessing and using the Platform, you agree to be bound by this Policy. By setting up a MyMuse Account, and/or purchasing any Products, you agree to our data processing, storage, usage, and sharing provided by you pursuant to this Policy. If you do not agree with any of the terms of this Policy or the Terms or wish to revoke any consent you have provided to us, please write to us at support@mymuse.in. However, if you revoke any mandatory permissions then we may have to cease providing you with access to the Platform and the Products, Information and services therein to you.

6. Data Retention

We shall retain the information you provide to facilitate your smooth and uninterrupted use of the Platform, and to (i) provide, improve and personalize our Platform; (ii) contact you about your MyMuse Account; (iii) give customer service, personalise our marketing communications; and (iv) prevent, detect, mitigate, and investigate fraudulent or illegal activities. We do not retain your personal data for longer than required for the purpose for which the information may be lawfully used.

7. Data Security

We use appropriate technical and organizational security measures to ensure protection of the personal data. The transfer of personal data between your end device and us is generally carried out in an encrypted form (TLS encryption). You can identify an encrypted connection for example by the lock symbol in the address line of your browser. If you communicate with us by e-mail, access by third parties cannot be ruled out. However, remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

8. Cross Border Data Transfer

Personal data we hold about you may be transferred to other countries outside your residential country for any of the purposes described in this Policy. You understand and accept that these countries may have differing (and potentially less stringent) laws relating to the degree of confidentiality afforded to the information it holds and that such information can become subject to the laws and disclosure requirements of such countries, including disclosure to governmental bodies, regulatory agencies and private persons, as a result of applicable governmental or regulatory inquiry, court order or other similar process. In addition, a number of countries have agreements with other countries providing for exchange of information for law enforcement, tax and other purposes. If we transfer your personal data to third parties for purposes stated in this Policy, we will use best endeavors to put in place appropriate controls and safeguards to ensure that your personal data is kept accurate, adequately protected, and processed only for specified and reasonable purposes in a manner that is fair, transparent and has a lawful basis, and is stored for no longer than is absolutely necessary.

9. Children's Privacy

9.1 Our website is directed to be used by adults 21 years of age and above only. If you do not fulfil said condition, you should not access our site and you should not make any purchase, register, or submit personal data to us. We or our associates /affiliates do not knowingly collect information from minors.

9.2 If you are the parent or legal guardian of a minor who has registered on our website, or who you believe has otherwise provided data to us, please contact us using the details set out below to have the information deleted.  We encourage parents and their legal guardians to inform minors about how to use the Internet in a safe and responsible manner.
